2.1. Content” It includes every information including text, images,  audio, video, or other information made available on our website may  include content which is controlled or owned by third parties which we  have taken permission to make available to you through the Website.  

2.2. BMACS (Brits Medical and Cosmetic Services) which is private  medical service provider. www.privatemedicalservice.com , www.bmacs.org.uk , www.bloodtestexpert.com 

Our company is registered in England and Wales with company  registration number 12512117. Our registered office is at Westerly the  green, Horton Road, Horton, SL39NU, United Kingdom.  

2.3. “Specialist” means a health specialist listed on the Website.

3.1. This is a legal agreement between user of website / our services  and our professional team member.

If you are using our website or services without  reading our terms and conditions, it will indicate that you have accepted  our terms and conditions. 4.1. You can search the services listed on our website in various  specialized fields. You may also find the information you are looking for  or you have an option available to request further information if you may  wish. 

4.2. We reserve the right to amend or remove the information provided  on our website without notice. There might be sections of website for  which you might need to register to view. We may restrict your access to  some or all parts of our website at any point if feel necessary. 

4.3. We will not be responsible for the website to be unavailable at any  point. 

4.4. You can only take active part, post reviews, ratings, or opinions if  you are registered member.

4.8. If our website / content is being used in breach of our terms and  conditions mentioned, we reserve the right to cease your permission to  use BMACS website and you are expected to either return the material  or to destroy with immediate effect.

5.1. Our listed specialists are registered with UK government recognised  institutions and hold active valid licence. Content provided on our  website about specialists either by themselves or obtained directly by  BMACS or taken from publicly available databases.  

5.2. As registered health professional it’s your responsibility to make  sure information provided is up to date and accurate. We do not take  any guarantees or warranties about the accuracy of the content provided on BMACS website. We reserve the right to use intellectual property,  content in accordance with these terms and conditions.  

5.3. It’s your responsibility to make sure you are expert in the field  mentioned on our website, qualified as per UK healthcare provider  eligibility criteria, and have appropriate insurance cover. We are not liable in anyway or form for anyone else, about the diagnosis/decisions  made, or treatments provided by yourself.  

5.4. We will refer patients for opinions, procedures to you only if you  agree with our terms and conditions. You are fully responsible to be  capable and eligible for providing the needful service you are providing.

5.5. If as specialist or as practice you are collaborating with BMACS, we  will be putting your information on our website to market your services  for which you may have to pay fee if agreed prior to collaboration or at  any point after. 

5.6. As specialist or practice if you are collaborating with BMACS so we  can refer patients, you need to give us right to be able to put your profile  on our website for which you might or might not have to pay a fee. Your profile or practice will be on our website which will be irrevocable,  worldwide, transferable, royalty free, non-exclusive, sublicensable www.bmacs.org.ulicence so we can use information on our website as required or other  media source which include any old or new for marketing, research purposes.   

5.7. BMACS automatically obtain reasonable consent to offer disclosure  of the content / information / services provided by specialist/specialist’s  practice for clients / patients visiting our site. The content needs to be continually monitored and updated by the specialist or the practice. The  specialist and the practice give BMACS irrevocable consent to disclose  the information where necessary.  

We might seek evidence of the specialist and/or specialist’s practice  entitlement to a level that would reasonably satisfy our code of practice.  

We may also ask the Specialist and/or their practice to provide us with  suitable documentary evidence that will reasonably satisfy us of the  Specialist and/or Specialist’s practice’s entitlement to make use of the  intellectual property right in the Content and to permit us to make use of  such intellectual property rights and the Specialist and/or Specialist’s  practice agree to provide such evidence upon request. 

5.8. As per BMACS code of ethics the specialist and specialist’s practice  including all involved employees and service providers comply with  anticorruption laws.  

5.9. If specialist or his employee become aware of any breach of clause  including 5.7 and 5.8, they must notify us immediately. We reserve the  right to take appropriate action which may include immediate suspension  account / contract with us with or without any need to notification. If any  investigation takes place their after, the specialist, practice, and  employee are expected to assist BMACS in investigation process. 

5.10. The specialist and or the specialist’s practice is expected to  indemnify BMACS and hold BMACS harmless on demand against any  claims, proceedings, actions, costs and compensation (including legal  costs and disbursements on a full indemnity basis), damages, losses,  fine/fee expenses, and other liabilities of whatsoever nature brought  against BMACS arising out of or in connection with such breach. 

  1. Customer / patient 

6.1. If you request BMACS to suggest specialist for the health issue you  www.bmacs.org.u

may have, we will do our best to put your case forward to appropriate  specialist but as customer or patient you are responsible for selecting  your own health care specialist and taking on any offered advice,  BMACS  

diagnosis, treatment or procedure. As final decision will be yours so  BMACS do not take any liability if you may have any grievance,  complaint or claim against the specialist or their practice you may have  seen the specialist.  

6.2. Website content is for your information only, this must not be taken  as any kind of recommendation. You must not use content of website  against professional medical advice. Do not delay of avoid professional  medical advice on basis of content of any website. In case of medical  emergency please dial 111. 

6.3. We will recommend you healthcare specialist as per the information  you provide us which can be as per medical need, location and  availability etc. Decision is entirely yours weather you chose or decide to  go with someone else and we will support you. 

6.4. Healthcare professional listed on BMACS website have contract  with us and may or may not be paying fee to be marketed on our  website.  

6.5. Any fee, payments you incur for treatments, procedures missing /  late / change of appointments / penalties etc is your liability directly with  specialist.  

6.6. Booking specialist via BMACS, we might hold your data as per our  privacy policy. By agreeing with us to refer you to specific healthcare  specialist, you also agree for us to share your data with third party. If you  do not agree, please do inform us prior to referral.

  1. Feedback about specialist or services  

7.1. Our mission is to make sure you and others in need get best  possible care, treatment, or procedures, for that reason we would like  you to give feedback about your experience with specialist. We request  you to submit your review directly to BMACS.  

You are obliged to respond and reflect professionally and responsibly  when giving feedback.  

7.2. We reserve the right to do the final checks to avoid any  www.bmacs.org.u

unprofessional, inappropriate, deceptive, misleading or with identifiable  names solely for the purpose of maintaining anonymity and fairness. BMACS  

7.3. If you find any review inappropriate, offensive, or discriminatory,  please lease with us and we will thoroughly investigate and evaluate, if  found appropriate will ask to amend or even remove the review.  

7.4. We reserve the right to reject or remove the review if found  inappropriate, offensive, or discriminatory. We will also post responses  to reviews which can be from either specialist or other patient or  customer.  

7.5. You are allowed only one review per visit to specialist or healthcare  service provider. If we find review unprofessional, inappropriate,  deceptive, misleading, we will identify IP address to assess the source of  review and take appropriate action where necessary. 

7.6. If we find multiple reviews submitted by same reviewer, we may  remove the once we feel appropriate.  

7.9. Your reviews will might not be published straight away as these are   

usually forwarded to our team who post reviews after going through to  make sure we are maintaining anonymity and fairness. 

7.10. The specialist you see might collect reviews on the basis your  experience of visiting them or their premises and might request you to  complete questionnaire. This is independent from BMACS and in no way  or form should reflect you views, opinions of BMACS.

  1. Website terms  

8.1. You might find content out of date or with errors and we reserve the  right to change the content as soon as we can without the obligation of  updating it on time or when requested. 

8.2. On occasions website might not be available which can be out of  our control so we are not obliged to guarantee to provide continuous  access. Our team will do everything possible to make sure interruption is  for minimal possible time.  

8.3. We reserve the right to change domain name or even close the  website down if required because of some unforeseen circumstances.  BMACS  

8.4. We reserve the right to change terms and conditions when feel  necessary without any notice and it is your responsibility to check it  every time you use our website as every time when you use website,  assumption will be that you have read our terms and conditions and you  are agreeing. If you find some terms and conditions with which you do  not agree please do not use our website.  

  1. Memberships and communication 

9.1. As a patient or clinicians if you are granted any type of access to our  website, it’s your responsibility not to disclose security information to any  third party. 

9.2. We reserve the right to limit your access or even disable it if we  have any reason to believe you not complying with our terms and  conditions. 

9.3. We recommend if you find anyone in breach of our terms and  conditions to inform us and we will keep the information confidential.  

9.4. By accepting BMACS terms and conditions you as clinician /  specialist or patient / client you agree for us to communicate with us via  paper, website or emails. 

9.5. If as clinician / specialist or patient / client you find any of BMACS  terms and conditions not in accordance with legal requirements or not  legally applicable please do contact us as soon as possible and we with 

mend or delete as per legal required. Once appropriate action has been  taken, we are not obliged to update you or organisation directly. 

  1. BMACS – Law, liabilities, limitations 

10.1. The Specialists treating you will be responsible for any negligence,  personal injury, death, misrepresentation, or website content as per  English law and only permitted representations of conditions and missed  treatments or website content can be expectable by UK law.

10.2. BMACS do not take any responsibility of any negligence or breach  of contract between the client / patient and treating specialist / person  which can be as per our website content (which is responsibility of each  

BMACS  

specialist or person involved to make sure the content about them or  their services / practices is updated on regular basis and is correct). 

10.3. BMACS does not take any liability for any damages caused by  common cyberattack where malware (normally malicious software)  executes unauthorized actions on the victim’s system which may infect  your computer and may cause loss or damage to content or website. 

10.4. If you are using permitted content of BMACS website but we take  no responsibility of any damage which may arise from use of content of  our website.  

10.5. As per our terms and conditions in all circumstances if considered  liable weather in contract which include negligence, our maximum  aggregate liability shall be limited not more than £99. 

10.6. If you as a client/patient, medical, nonmedical professional or  organisation have any contractual or noncontractual dealing with  

 

BMACS, it will be understood that you agree with our terms and  conditions.  

10.7. If there is any dispute or claim against BMACS terms and  conditions use will be subject to jurisdictions of UK courts.

11.1. BMACS reserve right to suspend temporarily or permanently your  contract or account with us or for use of our services, website, or use of  content of our website immediately if deemed appropriate where found  

evidence which satisfy our opinion. Similarly, you (as a client / patient or  specialist) have equal right to limit, suspend or terminate established  contract with BMACS.  

11.2. If your account is suspended temporally / permanently suspended  www.bmacs.org.u

or terminated, you must stop using our website or services until further  reinstated. Until your account is reinstated you are expected to not to  use your account with and delete it.

  1. Transferring rights  

12.1. The contract between us of use of services or website is also  binding you and our current and future representatives / successors.  

12.2. By using our website / services you agree to our terms and  conditions according to which you may do not automatically transfer your  rights or obligations without our written consent.  

12.3. If we find any breach of our terms and conditions, we reserve the  right to terminate our contract and permission to use our services and  website.

14.2. Your content might be shared with other institutions or  organisations. 

14.3. As client / patient, medical or nonmedical specialist It’s your  responsibility to make sure the content you provided is legitimate, have  appropriate consent if required and not breaching any copy or  proprietary rights. 

14.4. As medical or non-medical professional it’s you upmost  responsibility to make sure you hold appropriate licence for the service  you provide for BMACS clients / patients.

take no responsibility or liability of the contents and information provided. 

15.2. If you find any information which you feel is not as per our terms  and conditions, you can contact the website directly for any liabilities.

Any Client/ patient/ specialist or any third party, which include any  parent, or affiliated with BMACS not in agreement with BMACS terms  and conditions shall not have any rights under the Contract (Rights of  Third Parties) Act 1999 which gives powers to third parties in certain  circumstances to enforce terms of a contract that confer a benefit upon  them, either expressly or as a matter of contractual construction.
